The floral services Contract has no specific requirements.
Running an event floral design business just ain’t easy. First, you’re dealing with a fungible item that can deteriorate at the slightest stress. You also have to deal with the flowers.
Thankfully, flowers aren’t math. Only math is math. In other words, flowers are not an exact science. Depending on the time of year, how the distributor treated them in transport, and a host of other issues, flowers may not be the exact same shade as anticipated. They might not have the same structural integrity from one bunch to the other. This is the nature of the flowers. Placing the client on notice that you may make reasonable substitutions based on common problems (think color or shade, quantity, etc.) is crucial.
That is why you can create your own contract which protects YOU because a Client is always right.
We accept a limited number of events per week. So, we suggest contacting us as early as possible in your planning process. Once you decide to book Mila Design after the initial estimate, we schedule an in-person meeting to go over your vision. We ask that you come prepared with your ideas, pictures, and color swatches you may have. If you are not sure what your style is, we are committed to working with you to produce custom designs within a reasonable price range. The initial meeting is strictly to discuss Mila Design services and the Client’s vision.
Dates are booked on a first-come, first-served basis. You can secure your date with a deposit (30% of the total estimated cost) and a signed contract. The deposit is non-refundable. The Contract accompanies the attached Proposal for Floral Design and Rental Services.
The signature at the bottom of this page implies acceptance of the terms and conditions stated herein.
It is understood that Mila Design will work as the sole and exclusive florist for your event. By signing this Contract the Client agrees that no other person (including the Client) or company shall provide fresh or artificial floral products for the Client’s event location without the consent of Mila Design. This clause is to protect the image of Mila Design from assumptions that might occur from the event’s attendees. Some exceptions may apply after discussing with Tatiana Chelekhova.
All payments are non-refundable 14 days prior to an event. Clients shall pay any attorneys’ fees, court costs, or other costs incurred in the collection of delinquent accounts. Order must be paid in FULL 14 days prior to the date. If the event is booked within 30 days of the event date, the invoice must be paid in full. Design services and coordination cannot be changed 14 days prior to the event day. We accept checks or cash for all payments.
Mila Design uses only the best products available. On the rare occasion, that a product is not available at the flower market, Mila Design reserves the right to make substitutions in the event the flowers received are not of the quality suitable for your wedding or special event. In this event, the integrity of the proposed color scheme will be maintained and flowers of equivalent value will be used.
It is your responsibility to notify Mila Design immediately after delivery to the event venue if you notice something does not meet your expectations. Fresh flowers are subject to wilting or showing negative effects when placed in a room with a temperature of 72 degrees or higher or are subject to warm or cool drafts. In the event that arrangements are delivered incorrectly, Mila Design will review the case and make a decision on what will be credited.
By commissioning Mila Design to design and create floral pieces for your event, we entrust Mila Design to choose all floral varieties, color schemes, and textures that will best showcase the ideas for the event. By signing this agreement, we allow Mila Design to create distinctive and unique floral pieces and interior décor.
Invoice for rental event props has to be paid in full prior to the event.
The renter is responsible for the loss or damage of item(s) and will pay for the cost of replacement or repair. This cost will be assessed the next day after the event and presented in a separate invoice payable within 15 days. The replacement value of item(s) will be determined by age and condition at the time of rental.
CUSTOMER PROVIDED ITEMS
Items provided for flowers or décor must be clean, and ready to use. Mila Design is responsible for items ONLY during setup and not responsible for any item left at the venue after the resolution of the event. The client is reasonable for removing items from the event venue.
In the case of heavy wind or extreme heat, Mila Design will be limited. We do our best even in the harshest of conditions to get the job completed, but weather can be an issue outdoor and we will have to adjust the plan. We will do our best to still achieve your ideal vision even in these conditions, and we will make you well aware no matter what.
The flowers are designed to preferably be out of the water while you walk down the aisle, and for a very short time at the reception. In order to keep personal flowers fresh, please schedule your photographer to take pictures after the ceremony.
Please keep bouquets in water before the event as much as you can to avoid wilting.
Please remind your guests to wear flowers, real flowers are fragile and they need to be gentle on hugging.
CANCELLATION OF SERVICES RENDERED
In the unfortunate event that either Client decides to cancel or call off the event for any reason, an official notice of termination of the Contract due to the cancellation of the event must be given to Mila Design in writing and the following terms shall apply: Mila Design shall be entitled to retain the non-refundable, non-transferable fee. If the notice of termination is received by Mila Design less than (14) days prior to the event date, the Client individually or Clients jointly shall be responsible for one hundred percent (100%) of the remaining balance of the payments.
Cancellation due to the loss of life or hospitalization of the Client individually or one of the Clients jointly shall result in full termination of the Contract and reimbursement of tendered payments in full.
Mila Design charges a design fee. The delivery fee is based on mileage. Hourly fees for set up/reset/pick up rental props time with incurring for staff.
